International Commercial Mediation Center for Belt and Road Initiative Fee Schedule (For Trail Implementation)

International Commercial Mediation Center for Belt and Road Initiative (hereinafter referred to as the “Mediation Center”), in accordance with the Articles of Beijing Retio Legal and Commercial Service Center for Belt and Road Initiative and other related regulations, “Mediation Rules of International Commercial Mediation Center for the Belt and Road”, as well as the international practice, domestic and international arbitration, mediation and judicial fee schedules, and combined with the Mediation Center’s actual work, develops this Fee Schedule.

The parties involved in mediation conducted by the Mediation Center shall pay the corresponding fees to the Mediation Center. The fees include registration fees, mediation fees and case processing fees. Fee standards and implementation measures are as follows:

 

I.Registration Fee

Registration fee is RMB 200 for each party. The filing party shall pay the registration fee upon submitting the mediation application form and the responding parties shall pay the registration fee upon confirming participation of the mediation. The registration fee is non-refundable for any reason.

 

II. Mediation Fee

 1. Mediation fee is calculated based on the claimed amounts. Fee schedule is as follows:

2. If the amount of claim cannot be determined, the Mediation Center and the mediator shall determine it in accordance with the principle of fairness.

3. The parties shall pay the mediation fee in full and on time to the Mediation Center before the initiation of the mediation.

3.1 The parties shall, within 5 business days after receiving the payment notice, pay the Mediation Fee to the designated account and submit the payment voucher (scanned copy of the payment voucher) to the Mediation Center.

3.2 If the actual amount of claim was found not in accordance with the amount stated in the application form during the mediation process, the difference resulted in the mediation fee shall be made up.

4. The mediation fee shall be equally shared by the parties, or in such other proportions as the parties have agreed in writing.

 

III. Case Processing Fee

1. Expenses incurred in connection with the mediation, which is conducted either online or offline, shall be determined on a reasonable basis by the mediation center and be charged to the parties. Such expenses including but not limited to postage, correspondence, room rental, travel, venue change related expenses that incurred due to the hiring of mediators, translators, stenographers, experts, witnesses, etc.

2. The parties shall pay the case processing fee prior to the mediation. The parties shall, within 5 business days after receiving the payment notice, make the payment in full amount to the designated account.

3. The case processing fee shall be equally shared by the parties, or in such other proportions as the parties have agreed in writing.

 

IV. Refunds

1.After the termination of the mediation, where the mediation concludes without reaching a settlement agreement, the Mediation Center shall be reimbursed by the parties for the necessary costs, but not exceed of 50% of the mediation fees that actually collected, the balance shall be refunded to the parties.

2. After the termination of the mediation, where the mediation concludes with a settlement agreement, the unused portion of the pre-paid case processing fee will be refunded to the parties.

3. In the event the parties do not pay the mediation fees on time and in full amount, the Mediation Center shall have the right to terminate the mediation.

 

V. The mediation cases entrusted by other agencies (including but not limited to courts, arbitration institutions, mediation institutions and etc.) shall be processed in accordance with their corresponding regulations respectively.

 

VI. Supplementary Provisions

1. This Fee Schedule shall enter into force as of the date of promulgation.

2. The matters not covered in this Fee Schedule shall be supplemented and perfected by the Mediation Center.

3. This Fee Schedule shall be interpreted by the Mediation Center.
