The Credential of Chinese Mediators of the Mediation Committee of the BNRMC

A Chinese mediator shall fulfil the following requirements.

1. Possesses the full capacity for civil rights and capacity for civil conduct, a certain level of legal knowledge, policy and education, the passion for the commercial mediation work, fairness and decency, has never been given criminal punishment and upholds the principle independence and equity;

2. Has practiced arbitration, mediation, trials and other dispute solution work for more than 8 years, or has worked as a legal researcher, teacher or layers for more than 8 years, is familiar with the corresponding laws, regulations, is skilful at the commercial business concerning the foreign affairs and has the professional experience and capability;

3. Observes the articles, mediation rules, code of conduct for mediators and the other regulations of BNRSC;

4. Masters a foreign working language; for those with sufficient international commercial experience this criterion can be appropriately loosened;

5. Can guarantee working time for mediation;

6.And other conditions of the Mediation Committee.

A foreign mediator shall fulfil the following requirements:

1. Possesses a nationality of a sovereign state, has passion for the mediation work, fairness and decency，has never been given criminal punishment and upholds the principle of independence and equity;

2. Has professional knowledge and working experience about law, trade, technology and maritime affairs;

3.Observes the articles, mediation rules, code of conduct for mediators and the other regulations of BNRSC;

4. Masters one or more of the following languages: Chinese, English, French, Russian, Arabic and Spanish;

5. And other conditions of the mediation committee.

For a mediator from Hong Kong, Macau or Taiwan, the requirements for the foreign mediator shall apply.
